Welcome to CrypGuard Genesis! These Terms of Service ("Terms") govern your use of our Discord security bot. By adding CrypGuard Genesis to your Discord server, you agree to be bound by these Terms.

1. Service Description
1.1 What CrypGuard Genesis Does
CrypGuard Genesis is a Discord security bot that detects:
- Scam messages and phishing attempts
- Impersonation attacks (users mimicking server admins)
- Malicious URLs and files
- Suspicious account behavior
- Social engineering attempts
1.2 What CrypGuard Genesis Does NOT Do
CrypGuard Genesis is a TOOL, not a GUARANTEE. We do NOT provide:
- 100% threat detection — No security system is perfect
- Insurance or financial protection — We are not liable for losses from undetected scams
- Legal advice — Alerts are informational only
- Guaranteed uptime — Downtime may occur
- Human moderation — You must review alerts before acting
2. Acceptance of Terms
By using CrypGuard Genesis, you agree to:
- These Terms of Service
- Our Privacy Policy
- Discord's Terms of Service and Community Guidelines
Server Owner Authority: Only the Discord server owner or authorized administrators may add CrypGuard Genesis to a server.
3. Subscription Tiers & Pricing
3.1 Scout (Free Tier)
- Cost: Free forever
- Features: Basic threat detection, simple alerts, community support
- No credit card required
3.2 Sentry Pro (Paid Tier)
- Current Price: $14.99 USD/month (Early Adopter rate)
- Free Trial: 14 days with full access
- Billing: Monthly via LemonSqueezy. Cancel anytime.
3.3 Price Changes
Prices may change with 30 days notice. Changes do not affect active subscriptions until next renewal.
3.4 Early Adopter Price Lock
Early Adopter subscribers get $14.99/month locked forever while their subscription stays active. If payment lapses beyond the 72-hour grace period, the lock is permanently lost.
4. User Responsibilities
4.1 Review All Alerts
You MUST review alerts before taking action. CrypGuard provides threat assessments, but YOU decide what action to take. Do not blindly kick/ban users based solely on bot alerts.
4.2 Maintain Server Security
CrypGuard is ONE layer of security. You remain responsible for server permissions, Discord's built-in security features, moderator training, and prompt response to alerts.
4.3 Grant Necessary Permissions
The bot requires: View Channels, Send Messages, Embed Links, Read Message History, and Add Reactions.
We do NOT request: Administrator, Manage Roles, Manage Channels, Ban/Kick Members, or DM access.
4.4 Prohibited Uses
You agree NOT to:
- Abuse the bot — spam commands, attempt to crash or degrade the service, or trigger excessive false alerts deliberately
- Reverse-engineer detection logic — using the bot's alerts (or absence of alerts) to map which patterns, keywords, or behaviors trigger detection
- Probe or map detection thresholds — sending test messages, URLs, or files specifically to determine where CrypGuard's detection triggers or does not trigger
- Evasion research — using CrypGuard in any server to study, develop, or refine methods for bypassing or defeating our detection systems
- Publish evasion methods — sharing or communicating to any third party how to bypass or evade CrypGuard's detection
- Automated probing — using bots, scripts, or automated tools to systematically test CrypGuard's detection responses
- Harass, defame, or target users — using bot alerts to wrongfully target innocent users
- Resell or redistribute — offering CrypGuard as your own service without authorization
Violations may result in immediate termination without refund.
4.5 Detection Integrity Protection
CrypGuard Genesis exists to protect Discord communities from scams and fraud. Attempting to circumvent our detection actively harms every server and user we protect. We reserve the right to:
- Remove the bot from any server showing detection probing or evasion research behavior
- Permanently ban servers and their owners from re-adding the bot
- Report systematic evasion attempts to Discord Trust & Safety
- Pursue legal remedies where applicable under the Australian Cybercrime Act 2001 or equivalent laws in the offending party's jurisdiction
5. Service Disclaimers & Limitations
5.1 "As-Is" Service
CrypGuard Genesis is provided "AS-IS" without warranties of accuracy, uptime, or error-free operation.
5.2 False Negatives (Missed Threats)
We cannot detect zero-day scams, sophisticated evasion, social engineering, or off-platform coordination. We are not responsible for losses from undetected scams.
5.3 False Positives (Incorrect Alerts)
Innocent users may be incorrectly flagged. We are not liable for consequences of acting on false positives. Always verify before acting.
5.4 Staff Permission Bypass
To prevent false positives, CrypGuard Genesis does not scan messages from users with the following Discord permissions: Administrator, Manage Server, Manage Roles, Kick Members, or Ban Members.
You acknowledge and agree:
- Messages from users with these permissions are not monitored by CrypGuard Genesis.
- If a privileged account is compromised (hacked, stolen, or shared), CrypGuard Genesis will not detect threats from that account.
- You are responsible for securing staff accounts, including enabling Two-Factor Authentication (2FA) for all users with moderation permissions.
- We are NOT liable for any damages, losses, or harm caused by threats originating from accounts with elevated Discord permissions.
5.5 Third-Party Dependencies
CrypGuard relies on Discord API, database providers, and LemonSqueezy. We are not liable for third-party failures.
6. Limitation of Liability
6.1 Maximum Liability Cap
Our total liability for ANY claim is limited to the lesser of: six (6) months of fees you paid, or $89.94 USD. Scout (Free) users: maximum liability is $0.
6.2 Excluded Damages
We are NOT liable for: financial losses from bypassed scams, lost crypto/NFTs, reputational damage from false alerts, lost revenue from downtime, emotional distress, legal fees, or any consequential/indirect damages.
7. Indemnification
You agree to indemnify and hold harmless CrypGuard Genesis from claims arising from: bypassed scams, false positive disputes, your misuse of the service, Discord ToS violations, or your server's data breaches.
8. Refund & Cancellation Policy
8.1 No Refunds
All payments are final. The 14-day free trial is your evaluation period. Billing is monthly with no long-term contracts.
8.2 Cancellation
Cancel anytime via LemonSqueezy billing portal or through our contact form. Features stay active until the billing period ends, then downgrade to Scout (Free).
8.3 Failed Payment — 72-Hour Grace Period
- LemonSqueezy retries the payment automatically
- If payment continues to fail, server is downgraded to Scout (Free)
- You have 72 hours to restore and keep your Early Adopter pricing
After 72 hours, your Early Adopter price lock is permanently lost. Resubscription requires paying the standard rate.
8.4 Exceptions
Refunds may be issued at our discretion for: prolonged outages exceeding 72 hours (caused by our infrastructure), or billing errors on our end.
9. Dispute Resolution & Arbitration
9.1 Informal Resolution First
Contact us via crypguard.com — Get in Touch before legal action. We respond within 14 business days.
9.2 Binding Arbitration
IMPORTANT: Disputes are resolved through binding arbitration, not court lawsuits. Governed by the Resolution Institute (Australia). No class-action lawsuits.
9.3 Class Action Waiver
All disputes must be brought individually.
9.4 Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes that proceed beyond arbitration shall be subject to the exclusive jurisdiction of the courts located in Melbourne, Victoria, Australia.
10. Termination
10.1 Your Right to Terminate
You may cancel your subscription or remove the bot from your server at any time. Your personal data is handled per our Privacy Policy retention schedule. All detection data is retained for 30 days for incident response purposes. See our Privacy Policy for the full breakdown by data type.
10.2 Our Right to Terminate
We may suspend or terminate your access to CrypGuard Genesis immediately and without refund if:
- You violate any provision of these Terms
- You abuse the service (spam, reverse-engineering, harassment)
- You engage in fraudulent activity (chargebacks, payment disputes)
- We detect patterns of behavior consistent with detection probing or evasion research
- We observe systematic testing of detection thresholds in your server
- We identify your server as being used to develop bypass methods for CrypGuard or similar security systems
- Any user in your server publishes methods for evading CrypGuard's detection
- Required by law or court order
10.3 Survival of Terms
Surviving sections: Limitation of Liability, Indemnification, Dispute Resolution, Intellectual Property.
11. Intellectual Property
CrypGuard Genesis (code, algorithms, branding, documentation) is protected by copyright and intellectual property laws. You may not copy, modify, reverse-engineer, or create derivative works.
You retain ownership of your server data. We do NOT claim ownership of your messages, user lists, or server content.
12. Changes to These Terms
We may modify these Terms at any time. Changes take effect immediately for new users and 30 days after notice for existing users. Continued use constitutes acceptance.
13. Privacy & Data Protection
13.1 Privacy Policy
Our Privacy Policy explains what data we collect, how we use it, and your rights. By using CrypGuard Genesis, you also agree to our Privacy Policy.
13.1.1 False Positive Dismissal
Server administrators may use !dismiss <user_id> to fully delete all detection data for a user at any time. The !dismissallow archive option is temporarily unavailable while we complete a compliance review. Only !dismiss (full delete) is currently available.
13.2 GDPR & Data Rights
If you are located in the European Union, you have the following rights under GDPR:
- Right to access your data
- Right to deletion via
!deletedata command (immediate — overrides retention windows)
- Right to data portability
- Right to object to processing based on Legitimate Interest (Art. 21)
- Right to restriction of processing (Art. 18) — request processing be restricted while accuracy or legal basis is disputed
- Right to lodge a complaint with your national supervisory authority if you believe we are processing your data unlawfully

14. Miscellaneous
- Entire Agreement: These Terms + Privacy Policy constitute the full agreement
- Severability: Invalid provisions don't affect the rest
- No Waiver: Not enforcing a provision doesn't waive our right to enforce it later
- Assignment: You may not assign without our consent
- Force Majeure: We're not liable for events beyond our control

BY USING CRYPGUARD GENESIS, YOU ACKNOWLEDGE THAT:

- You agree to binding arbitration for disputes
- The bot is a tool, not a guarantee
- You must verify alerts before taking action
- We are not liable for bypassed scams
- We are not liable for false positive alerts
- You will not hold us responsible for financial losses
